How do I register a rental agreement in Pune?

Published · Last updated: · 5 min read

In Pune, a rental agreement is normally made as a leave and licence agreement, and in Maharashtra it must be in writing and registered, whatever its length. You can register it online through the Department of Registration and Stamps (IGR Maharashtra) or at a sub-registrar office; you pay stamp duty of 0.25% on the total rent plus a notional interest on the deposit, and a registration fee of Rs 1,000 in municipal corporation areas such as Pune city.

Educational only, not financial, tax or legal advice. Fees and procedures change; check the current figures on the IGR Maharashtra website before you pay.

Why registration is compulsory

Section 55 of the Maharashtra Rent Control Act, 1999 requires every leave and licence agreement to be in writing and registered under the Registration Act. The duty to get it registered is on the landlord (the "licensor"), and the Act provides penalties for failing to do so. In practice, though, the tenant usually pays the stamp duty and registration fee unless the agreement says otherwise.

For the tenant, a registered agreement is the clearest proof of what was agreed: the rent, the deposit, the notice period and the term. Many employers, banks, schools and passport and address-change processes also ask for it.

Most Pune agreements are for 11 months, but a leave and licence agreement can run for up to 60 months. A longer term, with an agreed rent increase each year, can save you renegotiating and re-registering every year.

How stamp duty is calculated

Stamp duty on a leave and licence agreement falls under Article 36A of the Maharashtra Stamp Act. The commonly used formula is:

  • A = monthly rent × number of months
  • B = any advance rent or non-refundable deposit
  • C = 10% of the refundable deposit × number of years (a notional interest on the deposit)
  • Stamp duty = 0.25% of (A + B + C)

On top of that you pay the registration fee (Rs 1,000 in a municipal corporation area, Rs 500 in rural areas) and a small document handling charge. The IGR Maharashtra site has a calculator; use it for the final figure, because rounding and charges can differ slightly from a hand calculation.

Step by step: registering online

The IGR Maharashtra e-registration lets both parties register without visiting a sub-registrar in many cases. The steps are broadly:

  1. Agree the terms first. Rent, deposit, term, notice period, lock-in, maintenance, who pays electricity and society charges, and the rent increase if the term is longer than a year.
  2. Gather documents for the landlord, the tenant and two witnesses: identity proof, address proof and a photograph. The landlord also needs a property document such as the Index II, a recent property tax receipt or an electricity bill for the flat.
  3. Enter the details on the IGR leave and licence e-registration portal: property address, both parties, the term, rent and deposit.
  4. Pay stamp duty and the registration fee online through the government payment system and keep the challan.
  5. Complete identity verification for the landlord, tenant and witnesses, typically using Aadhaar-based authentication. If any party cannot verify online, the agreement can be registered at a sub-registrar office instead.
  6. Download the registered agreement once it is approved, and give the landlord and tenant a copy each.

If you prefer, you can register in person at a sub-registrar office. Book an appointment, bring the originals and copies of all documents, and make sure all parties and witnesses can attend.

A worked example

Example numbers only; these are not rents for any real flat:

  • Monthly rent: Rs 30,000
  • Term: 24 months
  • Refundable deposit: Rs 1,50,000
  • No advance rent or non-refundable deposit

Calculation:

  • A = 30,000 × 24 = Rs 7,20,000
  • B = Rs 0
  • C = 10% × 1,50,000 × 2 years = Rs 30,000
  • A + B + C = Rs 7,50,000
  • Stamp duty = 0.25% × 7,50,000 = Rs 1,875
  • Registration fee in Pune city: Rs 1,000
  • Total: about Rs 2,875, plus the document handling charge

Run your own figures through the IGR calculator before paying.

Common mistakes to avoid

  • Signing an unregistered agreement on stamp paper only. It is not a substitute for registration.
  • Paying the deposit before the agreement is signed. Pay by bank transfer or UPI to the owner's own account, against a receipt, and only once the terms are agreed in writing.
  • Leaving the deposit refund vague. Write down how much will be refunded, by when, and what deductions are allowed. Attach a signed inventory with photos of the flat's condition.
  • Not checking who owns the flat. The landlord on the agreement should match the property documents and their ID.
  • Forgetting police verification. Landlords in Pune are expected to share tenant details with the police. Ask your landlord to confirm it has been done.

Key takeaways

  • In Maharashtra, leave and licence agreements must be in writing and registered.

FAQ

Is an 11-month rental agreement exempt from registration in Pune?

No. In Maharashtra, Section 55 of the Maharashtra Rent Control Act requires leave and licence agreements to be registered regardless of their length, so an 11-month agreement must be registered too.

Who pays the stamp duty and registration fee?

The law puts the duty to register on the landlord, but the cost is commonly paid by the tenant or split between both. Agree it in writing before you start.

Can I register the agreement without going to an office?

Often, yes. IGR Maharashtra's online e-registration lets the parties enter details, pay and verify their identity online. If online verification is not possible, register at a sub-registrar office.

What if the agreement is not registered?

The landlord can face penalties under the Act, and both sides lose the clearest written proof of the terms if there is a dispute over rent, deposit or notice.
